1. PURPOSE
The initiative Co-Creation aims to provide to a User, that whishes and becomes an actual User, an electronic platform to share contacts and authentic and accurate information and allow a direct contact with the EDP Group (henceforth the “Services”), in order to enhance the productivity, efficiency and success of projects and initiatives related to the activity of EDP.
EDP shall endorse its best efforts to provide the User the adequate tools to meet and contact companies, professionals, researchers, developers, inventors or university students, whose work or study falls within the framework of activities of the EDP Group, sharing ideas, knowledge and developing projects and / or joint initiatives in the context of a credible and safe social networking.
Likewise, EDP provides the User an adequate tool to contact and submit its project proposals and initiatives to the EDP Group.
The User acknowledges that the present User Agreement is, in any case, subject to the image, culture and guiding principles of EDP Group, in particular, regarding the strict observance of all laws and regulations, and conformity with the highest standards and ethical and moral principles.
This User Agreement provides the terms and conditions of access and use of EDP Group websites (“Websites”). In the terms of the present Agreement, Websites will mean all the websites held by EDP Group that are in association with the initiative Co-Creation.
2. SUBJECT AND INTENT
The User acknowledges that, by accepting the conditions herein, is signing a legally binding contract with EDP – Energias de Portugal (henceforth “EDP”), which regulates the services provided under the Co-Creation initiative.
The Annexes “Privacy Policy” and “Intellectual Property Rights” are part of the User Agreement.
By accessing and using the services provided under the Co-Creation initiative on behalf of a company or another legal entity, the User remains also individually bound by the terms of use.
In case you do not intend to become a User, do not accept this User Agreement (Do not click on “Accept”), do not access, do not visualize, do not perform downloads and do not use any web page, information and/or the Co-Creation services.
By becoming a User, you acknowledge being properly and fully aware of the terms and conditions of the present User Agreement and agree to be bound by all of its provisions.
The websites network managed and controlled by EDP or by any other company of the EDP Group, comprehends various websites and Web pages. EDP’s websites are offered to you under the condition of acceptance, fully and without reserves, of the terms, conditions and notices provided in this User Agreement. The use of EDP’s websites embodies the full and unreserved acceptance of the aforementioned terms, conditions and notices. The use of specific EDP’s websites, included in the EDP websites network may be subject to additional conditions, stated in a different location in that website.
3. AMENDMENTS TO THE AGREEMENT
EDP reserves the right to periodically change the terms and conditions of this User Agreement, with or without notice, the User being responsible for the regular consultation of these conditions. In case significant changes are made to this User Agreement, the User will be notified by e-mail to the provided e-mail address, which must be permanently updated, or through a notice posted in the website.
The use of Co-Creation website Services after an amendment notice will be considered as an express acceptance by the User of said amendments.
4. WEBSITE CONTENTS
EDP does not control, nor can control, all communications and the contents posted by the Users in the website Co-Creation, and therefore cannot be held responsible, in any way, by the content of such communications and contents.
Notwithstanding, EDP reserves the right to block or remove from the site Co-Creation all communications or contents that may be considered defamatory, obscene, threatening, abusive, illegal, infringing the rights to privacy and publicity, or that may constitute or instigate the practice of an unlawful act, the infringement of rights of a Party or of any third party, or in any way give rise to civil liability or violate any legal provision.
The User expressly acknowledges that EDP, by providing a service that includes the possibility to view and distribute contents generated by Users, adopts a purely passive conduct therefore expressly rejecting any obligation or liability whatsoever for such contents or activities conducted on the website.
EDP warns that the displaying of any personal data by the User on the Co-Creation website will be treated by EDP under the terms of the Privacy Policy.
EDP may collect User information through various means, namely, those provided directly by the User, those obtained through visits to EDP Group sites, those collected through the use of Services provided and those collected from any other sources, in accordance to terms provided by law and according to the provisions of the Privacy Policy.
5. SOCIAL NETWORKS, CHAT ROOMS, PRIVATE GROUPS AND FORUMS
EDP may, although not obliged, monitor and review any areas on the Co-Creation website in which the Users transmit or upload information or contents, or communicate with each other, including, but not limiting, Social Networks, Chat Rooms, Informative Screens, Private Groups and Forums, as well as the content of any such communications. EDP shall not be held responsible for the contents of any such communications, which will be, in any circumstance, of the Users’ full responsibility.
The acceptance of a User in a Social Network, in Chat Rooms, Private Groups or Forums, does not constitute, nor can be construed as constituting, an acceptance of eventual proposals or initiatives by EDP, nor shall constitute or be construed as constituting an agreement or any kind of binding relationship with EDP.
6. SUBMISSION OF IDEAS, PROPOSALS AND INITIATIVES TO EDP
EDP provides the User with a specific form to submit the ideas, projects, initiatives, works, creations or inventions directly to EDP Group. All the information or contents submitted to the appreciation of EDP Group, in case the User intends to maintain the submitted information or contents as confidential, shall be kept as confidential only after the express mention of the User. EDP will regard all the submitted information and contents as being confidential, whenever such request is made by the User. EDP shall proceed with the data treatment under the terms specifically stated in the Privacy Policy.
The receipt of an idea, project, initiative, work, creation or invention, through a specific form for that effect, or by any other suitable means is not, nor can it be construed as constituting an acceptance of any proposals or initiatives by EDP, nor constitutes, or may be construed as constituting the entering into any agreement or bond whatsoever with EDP.
Any eventual partnership resulting from this User Agreement and, in particular, from the submission of any idea, project, initiative, work, creation or invention to EDP Group that may eventually be accepted will be established and formalized by direct and personal contact in the terms defined by the parties.
7. LINKS TO THIRD PARTIES WEBSITES
The Co-Creation website may contain some links to websites that are the property of third parties (“External Links”) and to that extent, are managed by these third parties. Notwithstanding, even if such third parties are somehow associated with EDP, the latter does not control nor can control such websites, as the same may have autonomous policies and practices of data processing independent of EDP. EDP cannot be held liable for these practices and is not responsible for the privacy practices or the contents of such websites.
The access to third party websites through External Links is of the sole convenience of the User and therefore the same will access them at his own risk. These External Links do not imply any sponsoring or endorsement by EDP or any relation of affiliation or association, or even imply that EDP has been legally authorized to use any such Intellectual Property Rights in connection with such websites.
The User, in order to clarify any doubts or questions related with third party websites, shall contact directly the Administrators of such websites.
8. WEBSITE USE
The User cannot copy, distribute, transmit, display, perform, replicate, publish, license, or do any works that result from the sale or transfer of any information, software, products or services obtained through the Co-Creation initiative.
It is expressly forbidden the amendment, change or introduction of any information whatsoever in the Co-Creation website, with the exception of the fields specifically created for that effect.
The content of the Co-Creation website, as well as all websites related with the Co-Creation Services, are for personal and non-commercial use. The User may, however, display, electronically copy, perform downloads and print copies of part of the contents of the Co-Creation website, as well as of all websites related to the Services, for commercial purposes, since expressly authorized for that effect.
It is expressly forbidden the use of abusive, obscene, violent, offensive, racist or xenophobic language or which may in any way violate the purposes or offend the spirit of the Co-Creation initiative and its community of Users in the Social Network, Chat Rooms, Private Groups and Forums, or any other similar means of communication.
The User cannot post, distribute or display contents that may be defamatory, obscene, threatening, abusive, illegal, in violation of rights to privacy and publicity, or that could constitute or induce the practice of an unlawful act or be considered as infringing third parties’ Intellectual Property Rights or that, in any way, are likely to give rise to any civil liability.
9. INTELLECTUAL PROPERTY RIGHTS
The content of this website, including without limiting, the texts, designs, graphics, interfaces, codes, or collective works under the terms of the Copyright Code and Neighbouring Rights, as well as other applicable laws, are property of EDP. The collective works include licensed works to EDP and all rights are reserved.
All the trademarks, logos, or other Industrial Property Rights on this site, are registered and are property of EDP, being its use by non-authorize third parties expressly forbidden.
10. NOTICES AND PROCEDURES FOR THE SUBMISSION OF CLAIMS
EDP must be immediately contacted in case the User considers, in bona fide, that a specific content posted in the Co-Creation website is inaccurate, illicit, or that it violates an Intellectual Property Right which is owned or held by the User.
EDP may remove or prevent access to a specific content displayed in the website, if it is subject to a Complaint, through which an infringement of Intellectual Property Rights, inaccuracy or illegality is invoked.
For the due purposes and bearing in mind the correct treatment of the Complaints, the User shall consult and follow the procedures contained in the Annex Intellectual Property Rights.
11. LICENSE AND WARRANTIES REGARDING THE CONTENTS OF THE CO-CREATION WEBSITE
The User is the holder of the information provided under the Co-Creation initiative, and has the possibility to request its removal at any time, except if the User shared information or contents with other persons that did not request the removal of that information and contents.
The User acknowledges and warrants that the information, directly or indirectly collected in the scope of the Co-Creation initiative, according to the terms of the Privacy Policy, is true, accurate and current and is provided in bona fide, without infringing any contractual provision or third party right.
12. LIMITED ACCESS
EDP considers essential the development of policies and procedures that ensure an increased protection for children and minors under the On-line initiatives and activities. Considering that the Co-Creation initiative’s scope consists in providing Users with a platform to share contacts and authentic and accurate information, as well as a direct contact with EDP Group, in order to enhance productivity and success for projects and initiatives, EDP deems that the same is not meant to be accessed and used by children nor minors.
The creation of User accounts by children and minors is expressly forbidden, and EDP reserves the right to disable or terminate any accounts held or suspected to be held by children or minors.
13. LIMITED WARRANTIES
EDP does not MAKE ANY WARRANTIES OR REPRESENTATIONS that the contents of the CO-CREATION WEBSITE are accurate, complete or current at all time.
TO THE FULLEST EXTENT PERMITTED BY LAW, EDP DOES NOT MAKE ANY WARRANTIES OR REPRESENTATIONS, INCLUDING WITHOUT LIMITING, THE MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS OF THE SERVICES FOR A PARTICULAR PURPOSE. IN CASE THE USER IS UNSATISFIED OR FEELS AGGRIEVED BY EDP OR BY ANY OTHER SERVICE RELATED WITH CO-CREATION, IT MAY REQUEST TO REVOKE THIS USER AGREEMENT AND DEMAND THE CLOSING OF THE RESPECTIVE ACCOUNT, BEING THESE, THE ONLY MEASURES THAT CAN BE ADOPTED.
EDP IS NOT RESPONSIBLE, NOR AT ANY MOMENT MAKES ANY WARRANTIES OR REPRESENTATIONS CONCERNING THE CORRECT DELIVERY OF ANY MESSAGES SUCH AS E-MAILS, ANSWERS OR TRANSMISSION OF CONTENTS GENERATED BY ANOTHER USER, SENT THROUGH THE CO-CREATION WEBSITE FOR ANY THIRD PARTY OR TO ANY OTHER MEMBER OF THIS SOCIAL NETWORK. EDP DOES NOT MAKE ANY WARRANTIES OR REPRESENTATIONS THAT THE USE DOES NOT INFRINGE ANY THIRD PARTY RIGHTS.
ALL THE CONTENTS, ELEMENTS, SERVICES OR TECHNOLOGIES, DESCRIBED OR USED IN THE CO-CREATION WEBSITE, MAY BE PROTECTED BY THIRD PARTY INTELLECTUAL PROPERTY RIGHTS, THAT MAY HAVE LICENSED TO EDP SUCH CONTENTS, ELEMENTS, SERVICES OR TECHNOLOGIES.
EDP HAS NO OBLIGATION TO VERIFY THE INDIVIDUAL USERS’ IDENTITY OF ITS SERVICES, NOR HAS ANY OBLIGATION TO MONITOR THE USE OF ITS SERVICES BY ANY OTHER COMMUNITY USERS.
ACCORDINGLY, EDP CANNOT BE HELD LIABLE IN RELATION TO IDENTITY THEFT OR IMPROPER USE OF IDENTITY OR PERSONAL DATA OF ANY USER.
EDP DOES NOT WARRANT THAT THE SERVICES WILL WORK WITHOUT WORKING INTERRUPTIONS OR ERRORS. IN PARTICULAR, THE SERVICES PROVIDED MAY BE INTERRUPTED FOR MAINTENANCE PURPOSES OR DUE TO UPDATES, OR EVEN SYSTEM OR NETWORK FAILURES. EDP CANNOT BE HELD LIABLE REGARDING SUCH FUNCTIONING INTERRUPTIONS OR ERRORS. EDP IS NOT RESPONSIBLE FOR INVALID DESTINATIONS AND TRANSMISSION ERRORS IN, CORRUPTION OF, OR THE SECURITY OF INFORMATION.
EDP CANNOT BE HELD LIABLE FOR ANY FAILURE, INABILITY OF ACCESS, OR WEAK CONDITIONS OF ACCESS TO THE CO-CREATION WEBSITE DUE TO THE USE OF INAPPROPRIATE EQUIPMENT, MALFUNCTIONS RELATED TO SUPPLIERS, TELECOMMUNICATIONS PROVIDERS’ OR DUE TO THE NETWORK OVERLOAD, AS WELL AS ANY OTHER REASON THAT IS LEGALLY ADMISSIBLE.
14. LIMITATION OF LIABILITY
EDP SHALL NOT BE HELD LIABLE BEFORE THE USER OR ANY THIRD PARTY FOR ANY DIRECT, SPECIFIC, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES OR OTHER, INCURRED, ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICES EVEN IN THE CASES IN WHICH EDP HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES TAKING PLACE.
15. COMPENSATION
The User will defend, indemnify and hold EDP, its employees, directors, representatives and suppliers harmless from and against any loss, liabilities, assuming directly the responsibility for any losses, expenses, damages or costs, including reasonable expenses with attorneys, arising from any breach of the terms and conditions of the User Agreement, or from the development of intentional or negligent practices or of any illegal activity through its User account, directly or through any third party using such an account.
16. TERM
The User may terminate this User Agreement, for any reason, at any time, upon previous notice to EDP. EDP may terminate this User Agreement, for any reason, at any time, with or without previous notice.
The termination of the User Agreement shall imply the immediate loss of access to the services by the User.
Whenever the circumstances justify, EDP, at its choice, may disable or terminate the User or Groups of Users accounts, responsible for displaying, distributing or disclosing contents considered to be infringing Third Party Intellectual Property Rights or to be considered inaccurate or illegal. The compulsory closure of a User account implies the immediate termination of the User Agreement.
The terms and conditions provided in this User Agreement, including without limiting, the provisions relating to Intellectual Property Rights, Claims, Limitation of Liabilities and Disclaimer of Warranties will be maintained regardless of the mode of termination.
17. CHOICE OF LAW; SEVERABILITY.
The present User Agreement shall be governed by and construed under the laws of Portugal and the Parties agree to submit to the exclusive jurisdiction of the Lisbon’s courts.
The Portuguese version of this User Agreement will prevail over any other existing translation.
If any provision of this Agreement is illegal or unenforceable, it will be deemed stricken from the Agreement and the remaining provisions of this Agreement will remain in full force and effect.
18. ENTIRE AGREEMENT.
This User Agreement, including its Annexes, contains the entire understanding of the parties with respect to its subject matter, and supersedes and extinguishes all prior oral and written communications between the parties about its subject matter.

Likewise, EDP provides the User an adequate tool to contact and submit its project proposals and initiatives to the EDP Group.
Being part of the Co-Creation network means not only knowing and contacting companies, professionals or university students, but also to share with them knowledge and information. The User account, according to the standard configuration, will only allow the sharing of information considered necessary and relevant by the large majority of Users.
EDP reserves the right, at any moment, to amend its Privacy Policy and therefore the User must review the same periodically. The relevant amendments to the Privacy Policy will be notified to the User through the e-mail address provided or through notice on this site. The use of Co-Creation website Services after an amendment notice will be considered as an express acceptance by the User of said amendments.

1. Information Collected
EDP may collect User information through various means, namely, those provided directly by the User, those obtained through visits to EDP Group sites, those collected through the use of Services provided and those collected from any other sources, in accordance to terms provided by law.
User’s information may be obtained through the following means:
- Register
The creation of a User account (“Register”) depends on providing the information as required in the Register Form, namely, Name, E-mail and Country, in case of natural persons, and Firm, E-mail, Web Site, Tax Identification Number, Postal Address, City and Country, in case of legal persons.
The creation of a Company User account will be subject, for safety reasons, to prior approval.
The acceptance of a new User account or a new User register does not imply nor can be construed as implying for EDP any kind of legal bond or any obligation to accept any proposal or initiative submitted by the User.
- Profile Information
The User can provide additional information in the field “Profile”, namely academic data, professional experience or scope of current activity. The disclosure of such additional information is of the strict responsibility of the User, since it is not mandatory. All the information provided by the User in his Register or Profile, can be used by EDP under the terms of the User Agreement.
- Contact Information
By using the Services the User can share documents and send invitations to other Users, interacting with them through:
- Social Network - open platform to share information;
- Chat Rooms - virtual space for interaction between Users to exchange instant information, opinions and ideas;
- Private Groups - virtual spaces reserved for interactions reserved to authorized Users for discussion and development of projects or initiatives;
- Forums - virtual spaces designed to discuss specific themes.
The Invitations are made through the website and the email address of the User is not revealed. The name and email address of people and companies invited are used to send User’s Invitations as well as the reminders in order to expand the network of the User.
EDP is not responsible for the nature and purpose(s) of the Invitations, by the choice of the Addressee(s), or for the use made of such Invitation and expressly warns that it is up to the User to assess its suitability.
The User may enter or manually add data or information concerning his contacts in the field "Contacts" of his account. The information and data inserted in the field “Contacts” is only accessed by the User.
The User is expressly prohibited from providing information or e-mail addresses of any persons, natural or legal, non Services Users, with exception of situations where it has the express consent of the owner.
All data and information introduced by the User in the field “Contacts” are subject to the terms of the User Agreement and this Privacy Policy.
- Site Use
EDP is authorized to collect information concerning the use of features and functionalities of the site made by the User for statistical and profiling purposes.
- Cookies
A Cookie is a small computer file that is stored on a PC when the User visits a site and allows the recognition of the User for future access to the site. The use of cookies is carried out to monitor the frequency and manner of use of EDP website and to help the online experience, to track site usage and trends, to improve the quality of Services and to customize the User’s experience. Upon registration in EDP sites the code can be stored in a cookie on the User’s computer.
The User can accept or reject the cookies. EDP emphasizes that the large majority of the browsers accept cookies automatically.
- Log Files, IP Address and Information on the User’s Computer and Mobile Device
According to the internet communication pattern when a User accesses the Co-Creation website, EDP receives automatically the URL of the site from where the User accessed and of the site to where the User goes after leaving the Co-Creation website. EDP also receives the internet protocol address (IP) of the User’s computer (or the proxy server used to access to the World Wide Web), the computer operational system and the type of browser used, the e-mail patterns, or the mobile device system (when the connection is made from a mobile device), as well as the User’s ISP name or the mobile operator. EDP uses the referred information exclusively for statistical purposes in order to analyze trends and help improving the Services.
- User’s Account
In case the User interconnects his Co-Creation account to other accounts or services or accesses third parties websites or services, together with the Co-Creation account, EDP can collect information related to the usage of third parties’ websites and services through the Co-Creation website, in the extent and within the aforementioned interconnection.
- Right to Access, Edit, Amend and Delete User’s Information
The User has, at all time, the right to access, edit, amend and delete the information and data provided to EDP, which was introduced at the time of Register or Profile creations.
2. Conditions and Method of Use of the Collected Information
- Information Processing. Consent.
The information and data provided by the User to EDP may disclose or allow other Users to identify the nationality, sex, age, geographic area, qualifications, work experience, educational background or field of activity when exceeding the requested and strictly necessary information. The User shall refrain from inserting in his Registration or Profile any information beyond the requested and, specifically, information that does not fall under the initiative Co-Creation. By providing information to create a User’s account or by adding any data to his Profile, the User expressly and voluntarily accepts the terms and conditions of this Privacy Policy and the terms and conditions of the User’s Agreement, which allow the processing of the information with the therein referred purposes.
Information provided to EDP, including information considered as confidential, constitutes a totally voluntary act from the User. The User has the right to revoke, at all time, the consent previously given to EDP to collect his data, according to this Privacy Policy and the User Agreement, by changing the Configuration or by terminating the Account. The consent revocation does not have, nor can be understood as having retroactive effects.
- EDP Communications
Under the terms of the User Agreement, EDP can communicate with the User through e-mail, notices displayed in the Co-Creation website or through any other available means. EDP may send a set of e-mails to inform the User on the functionalities and operation of the Services.
The User cannot choose not to receive messages concerning the Co-Creation Services. In case the User refuses to receive messages about the Co-Creation Services, EDP is automatically authorized to terminate his account.
- User Communications
In the communications sent by the User through the Co-Creation website only the User’s name will be displayed in the heading of the message. The communications displayed by the User do not provide information about the Contact Network nor list the persons with whom the User is connected.
The User’s contact information shall only be shared with other Users when a connection has been accepted by both parties.
- Content Customization
The information provided can be used to customize the User’s experience in the website, namely by exhibiting information related to the Users that have joined the User’s Contacts’ Network.
e. Sharing of Information with Third Parties
The privacy, the preservation and the security of the Users’ personal data in the Co-Creation website is a guiding and fundamental principle for EDP. EDP does not sell, rent or supply, in any way, User’s personal data to third parties. The sharing of personal data with third parties may only occur with express and previous consent of the User and for a determined purpose.
Third Party Service Providers. EDP works with third parties to develop and provide Co-Creation Services. The sharing of User’s personal data with a third party may be necessary for the good performance of the Services. EDP shall only share with Third Party Service Providers the personal data that is stricly necessary, ensuring that it complies with the terms of this Privacy Policy.
Other Situations. EDP may disclose the Users’ personal data when:
- Permitted by law in order to protect and defend EDP’s interests and rights (including, without limiting, to respect and enforce the terms and conditions of this Privacy Policy);
- Required by law, and/or public authorities in the scope of their duties.
Aggregate and Non Personal Information. EDP may use aggregate information for general analysis of the Co-Creation initiative, which cannot identify nor individualize the User.
f. Research
The Co-Creation website offers a research service to help the User locate and collect non-confidential information on other Users, in particular, name, electronic address, qualifications, work experience, educational background or field of activity. EDP may use the information entered in the User’s profiles and the contributions in Chat Rooms, Private Groups, Forums and documents, to inform or refine the search service.
g. Social Network, Chat Rooms, Private Groups and Forums
EDP advises Users not to place any sensitive information or content in the Social Network, in the Chat Rooms, in Private Groups or Forums. The displaying of any information or personal data in the Social Network, Chat Rooms, Private Groups or Forums that may allow the identification of the User, must be a conscious decision of the User and of its sole, complete and exclusive responsibility. EDP advises Users not to disclose in the Social Network, in the Chat Rooms, in Private Groups or Forums any confidential or sensitive contents or information concerning ideas, projects, initiatives, works, creations or inventions not legally protected.
EDP warns that all information or contents placed in the Social Network, in Chat Rooms, in Private Groups or Forums may be accessed by other Users and that will be able to read them, collect and use without EDP’s control or supervision. EDP waives any liability emerging from the information or contents that the User decides to provide in a Social Network, in Chat Rooms, in Private Groups or Forums.
h. Submission of Ideas, Projects and Initiatives to EDP
EDP provides the User with a specific form to submit the ideas, projects, initiatives, works, creations or inventions directly to EDP Group. All the information or contents submitted to the appreciation of EDP Group, in case the User intends to maintain the submitted information or contents as confidential, shall be made with the express mention of its confidentiality. EDP will regard all the submitted information and contents as being confidential, whenever such request is made by the User.
EDP warns that the Internet is not an entirely safe environment, so it cannot ensure full security of any information or data supplied by the User.
i. Personal Data Treatment
The User’s personal data is collected and inserted by EDP Inovação, S.A. in an automatic file in order to carry out any activity comprehended in the scope of the Co-Creation initiative.
EDP Inovação, S.A. may freely and unilaterally assign its position to any other company of the EDP Group.
The data completion is mandatory. The collected data may be forwarded to other EDP Group companies, with its head office in Portugal or abroad, to carry out any activities comprehended in the Co-Creation initiative. The collection and processing of personal data shall be made in accordance to the terms of Portuguese law, applicable and in force, and all the necessary authorizations will be obtained before the National Commission for Data Protection (“Comissão Nacional de Protecção de Dados”). Under the applicable law, EDP has implemented the necessary measures to ensure that the data provided is protected against non-authorized third party use or access. However, EDP warns to residual risks of unauthorized access through the Internet.
3. Selection and Access to User’s Information
- Access and Editing of Information in a User’s Account
The User may review the personal data provided to EDP and make all the necessary amendments in the displayed information or in the User’s account configurations, including the electronic address and preferences of contact. For such effect the User shall access his account at the Co-Creation website.
- Standard Configuration
The standard configuration implemented in the Co-Creation website corresponds to the needs and objectives of the initiative, in particular, the sharing of authentic and accurate contacts and information and the direct contact with EDP in order to enhance productivity, efficiency and success for projects or initiatives. EDP advises the User to review his account configurations and adjust them in conformity with his needs and preferences.
- User’s Account Termination
The User may terminate the User account through "My Area > edit profile > delete profile > Yes, delete my profile". If the User terminates his account, EDP shall delete the name and other personal or identifiable information from the publicly accessible databases. In case the User terminates his account, EDP shall not be obliged to keep any information or data previously provided. EDP may, however, preserve any information or data, provided by the User, when it might be considered necessary to avoid frauds or future abuse, account recovery or if legally mandatory.
4. User Obligations
The creation of a User account implies the acceptance of certain obligations before EDP and other Users. Some of the User’s obligations are imposed by the applicable laws and regulations while others arise from the use and practices of Social Networks such as the Co-Creation website:
- The User is obliged, at all times, to observe the terms and conditions of the Privacy Policy and User Agreement existing at the time, in particular in what concerns the compliance with all Intellectual Property Rights that may belong to third parties.
- The User may not insert, disclose or disseminate any information that may be considered to be harmful, violent, offensive, racist or xenophobic or which may in any way, infringe the purposes and offend the spirit of the Co-Creation initiative and its community of Users.
- The User cannot provide EDP and/or any other User information that he might consider to be offensive or harmful to himself, his profession or his personal status.
- The User shall keep his password secret and shall not share it with others.
The breach of any of these rules and principles may result in the restriction, suspension or termination of a User’s account at the sole decision of EDP and EDP cannot be held responsible.
5. Security
To ensure the User’s personal data protection, the access is secured with a password. In order to ensure the protection of any data stored by the User in a server associated with the Co-Creation website, EDP regularly audits its system to verify possible vulnerabilities or intrusions. EDP warns, however, that the internet is not an entirely safe environment, so it cannot ensure full security of any information or data provided by the User. The User is responsible for the protection of its personal data. EDP additionaly warns that e-mails, instant messages or any other similar means of communication that might be used to contact other Users in the Co-Creation website are not entirely safe and thus recommends that the User refrains from transmitting any confidential or personal data by such means.
6. On-Line Privacy for Children and Minors
EDP considers essential the development of policies and procedures aiming at ensuring an increased protection for children and minors under the On-line initiatives and activities.
Bearing in mind that the Co-Creation initiative aims at providing Users a platform to share authentic and accurate contacts and information, as well as direct contact with the EDP Group, enhancing productivity and success for projects and initiatives, EDP understands that the same is not primarily directed at children or minors.
In accordance, it is not allowed the creation of User accounts by children or minors and therefore EDP reserves the right to disable or terminate the accounts held or suspected to be held by children or minors.
7. Amendments to the Privacy Policy
EDP may introduce changes to the present Privacy Policy, at any time, with or without previous notice. In case significant changes are made to this Privacy Policy, the User will be notified by e-mail to the, address provided or through a notice inserted in this site.
The use of the Services provided in the Co-Creation website, after notification of the changes, will be considered as an express acceptance thereof by the User.

EDP aims, through the creation and development of the initiative Co-Creation, to provide its users a platform where authentic and accurate contacts and information are shared. Pursuing the objectives set for the Co-Creation initiative and in strict respect for Third Party Intellectual Property Rights, EDP shall endorse its best efforts to secure that in this website no contents or information infringing such rights are inserted, distributed or disclosed. The definition of Intellectual Property Rights includes Copyrights and Neighboring Rights, Industrial Property Rights and any other similar rights.
According to the User Agreement, the contents and information inserted by the Users must be authentic, rigorous, legally accepted and cannot infringe or be likely to infringe Third Party Intellectual Property Rights.
To comply with the objectives set for the Co-Creation initiative, EDP provides a method for submitting complaints regarding the contents and/or information inserted, distributed or disclosed by the Users.
The Policy and Proceedings adopted by EDP are stated in the following sections.
In the terms expressly provided in the User Agreement and in the Privacy Policy, EDP may remove or restrain the access to a specific content inserted in the website, in case such content is object of a Complaint based on Intellectual Property Rights infringement, inaccuracy or illegality. Regardless of any specific action to be taken, EDP reserves the right to forward the content of the Complaint submitted to the User responsible for its insertion in EDP’s website. EDP ensures that the User responsible for the display of the specific content object of a Complaint in the website will have the right to respond to such Complaint. EDP reserves the right to transmit to the Claimant the content of the Response to the Complainant, in case such Response is filed.
The restraining and removal policies and proceedings concerning the access to contents that allegedly or are likely to infringe Third Party Intellectual Property Rights or that are inaccurate or illegal, are of the sole responsibility of EDP and shall be pursued in accordance with the terms defined by EDP.
Whenever the circumstances justify, EDP, at its choice, may disable or terminate the User or Groups of Users accounts, responsible for displaying, distributing or disclosing contents considered to be infringing Third Party Intellectual Property Rights or to be considered inaccurate or illegal.
Notice:
The filing of a Complaint or a Response to a Complaint by a User shall be made under the terms expressly provided and should be lawful and accurate. The filing of a Complaint, or a Response to a Complaint, having a false or misleading content, may substantiate an unlawful practice. Considering the above, EDP advises the User(s) in case of doubt to previously request the counsel of a lawyer.
Complaints
In case you consider, in bona fide, that a specific content displayed in our website is in infringement of an Intellectual Property Right which you are the legal owner or holder, is inaccurate or illegal, please contact us immediately.
For all purposes and regarding a proper treatment of the Complaint, the same must contain:
a) Complete identification of the legal owner or holder;
b) Description and identification of the specific content and respective location in the website;
c) A description of the allegedly infringed right; a description of the contents considered inaccurate; or a description of the elements considered illegal;
d) Telephone and e-mail or address;

Response to Complaints
In case you consider, in bona fide, that a Complaint was improperly filed, by error or mistake, or lacks sufficient legal grounds, please contact us immediately.
For all purposes and regarding a proper treatment of the Response to a Complaint, the same must contain:
a) Complete identification;
b) Description and identification of the specific content to be removed or the access restriction to be applied;
c) A statement of grounds sustaining the disagreement towards the Complaint;
d) In case of a Response to a Complaint concerning an infringement of Intellectual Property Rights: a written declaration, duly signed, stating that the Respondent bona fide belief is that the use or display of the allegedly infringing contents was duly authorized by the rightful owner, holder, legal representative or agent of the owner or holder, or that such use is legally permitted.
